This Privacy Policy (“Privacy Policy”) provides information about (a) the information that Ultraviolet Devices, Inc. (collectively, “Operator” or “we” or “us” or “our”)collects when you use or interact with the online services that are part of our UVDI-360 System (the “Product”), including without limitation the online portal available at www.uvdi-360.com , (b) the ways in which Operator uses that information, and (c) your choices regarding use and disclosure of information including Personal Information. By using our Services you (“you” or “your”) consent to the policies and practices described in this Privacy Policy. As used in this Privacy Policy, the term “Personal Information” means information that identifies an individual personally, alone or in combination with other information available to us. Further, you acknowledge that this Privacy Policy is part of our End User Terms of Use, which is hereby incorporated by reference, and by accessing or using our Services, you agree to be bound by the End User Terms of Use (“End User Terms of Use”). 2. Information Collected By Operator through the Services | ||||||
Operator offers the Services to compliment and improve the use of the Product. The Services allow you to view data about the use of your Product(s) (including device usage and deployment data), control operation of the Product, and learn more about the Product. When you access and use our Services, Operator may collect information (i) that you knowingly and voluntarily provide when you use our Services (such as through forms or profile screens) including, without limitation, registration/account setup information, (ii) that your browser or computer shares with Operator, and (iii) that we are able to collect from your web browser, cookies and other similar technologies. We may aggregate and/or anonymize all information that we collect from you, including, without limitation, Personal Information, for the purpose of research on our Services.
A. Information that you Knowingly and Willingly Provide. Operator collects the information that you knowingly and voluntarily provide when you use our Services (such as through web forms or profile screens), including, without limitation registration/account setup information. We primarily use this information to authenticate users, provide appropriate access to data about the use and deployment of your Product(s), and to communicate with you about the Product(s). UVDI might also use the information that you provide to us for various business purposes such as providing customer service, market research, improving our products and services, and providing you with information about your use of Products. We may use your Personal Information in order to send you e-mail or other communications. If you would like to opt-out of receiving these communications , please contact us in accordance with Section 13 (Information Correction, Removal, and Opting-Out) of this Privacy Policy. The information that we collect and use may include, without limitation, the following kinds of Personal Information: • First and Last Name • Email Address • Login name B. Technical Information. Operator collects information that is sent to us automatically by your web browser or mobile device (i.e., tablet, mobile phone, etc.). Operator may use this information to generate aggregate statistics about visitors to the Services. This information typically includes, without limitation, details about your: • IP Address • Browser Type • Browser Plug-In Details • Operating System • Local Time Zone • Date and Time of Each Visit • Device Type (e.g. desktop, laptop, tablet, phone, etc.) UVDI might use such information for various business purposes such as providing customer service, authenticating users, fraud prevention, market research, improving our Services and improving our products. Information Collected by Cookies, Web Beacons and Other Technologies. Operator may obtain information about you by installing "cookies" on your computer's hard drive. We use cookies to collect statistical information about the ways visitors use our Services including, without limitation, which pages they visit, which links they use, and how long they stay on each page. Operator also may use cookies to create a database of your previous choices and preferences, saving you time and effort. The Services do not respond to web browser “do not track” signals. As such, your navigation of our Services may be tracked as part of the gathering of quantitative user information. If you arrive at our Services by way of a link from a third party site that does respond to “do not track” requests, the recognition of any “do not track” request you have initiated will end as soon as you reach our Services. |

5. Who Can Access the Information We Collect? | ||||||
Operator may disclose your Personal Information in the following instances:
Authorized Business Partners. We may enter into alliances, partnerships or other business arrangements with third parties to distribute, sell or service the Products. UVDI, our affiliates and our business partners may share this Personal Information with each other and use it consistent with this Privacy Policy. They may also combine it with other information to provide and improve their products, services, and supporting content. Designated Customer Personnel. We share users’ Personal Information with designated program leaders at the Customer which has deployed the Product(s). For example, a program leader at a Customer hospital using an Product will have access to certain Personal Information of that hospital’s designated users of the Services. Employees. Authorized UVDI employees may have access to your Personal Information. Service Providers. We employ other companies and individuals to perform functions on our behalf. Examples of such functions include, without limitation analyzing data, providing technical support, servicing Products, providing back office assistance, and providing customer service. We share our users’ Personal Information with these agents as we deem necessary for such third parties to perform their functions. Affiliates and Subsidiaries. UVDI might share Personal Information with our corporate subsidiaries and affiliates for uses consistent with this Privacy Policy. To Comply with Legal Process, Protect Operator, or Enforce our Rights. We may release your Personal Information when it is necessary to (i) conform to legal requirements or comply with legal process; (ii) enforce or apply our conditions of use and other agreements (iii) protect the rights, safety or property of UVDI, our affiliates, service providers, our users or the public, or (iv) prevent a crime or protect national security (including, without limitation, exchanging information with other companies and organizations for fraud protection and credit risk reduction). As Part of a Merger or Sale of Business. We may disclose your Personal Information in connection with a substantial corporate transaction, such as the sale of UVDI’s business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy. |

7. Children and Privacy | ||||||
Our Services are not directed to children under the age of 13. If you are 12 years old or younger, do not use our Services. Furthermore, we do not knowingly collect Personal Information from children under the age of 13. If we learn that Personal Information of persons less than 13 years-of-age has been collected through our Services, we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child or a minor under the age of 13 has submitted or otherwise communicated Personal Information to our Services without your consent, then you may email us so that we may take appropriate action to remove the minor’s Personal Information from our systems. |

A. Security. Operator takes technical and organizational precautions designed to protect the confidentiality, security and integrity of your Personal Information. Although we use security measures to help protect your Personal Information against loss, misuse or unauthorized disclosure, we cannot guarantee the security of information transmitted to us over the Internet. There is no guarantee that information may not be accessed, disclosed, altered or destroyed. You are responsible for maintaining the secrecy of your password and account information, and for controlling access to your email communications. The Services are not intended to store or transmit Protected Health Information (as defined in the Health Insurance Portability and Accountability Act of 1996) or other personally identifiable information related to the medical treatment, medical history, mental or physical condition or diagnosis of a patient. B. Storage. The Personal Information that you provide to Operator is generally stored on servers located in the United States. If you are located in another jurisdiction, you should be aware that once your Personal Information is submitted through our Services, it will be transferred to our servers in the United States and that the United States currently does not have uniform data protection laws in place. C. Retention. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. If you wish to cancel your account, contact your designated Customer Program Administrator. |

UVDI is headquartered in the United States. Your Personal Information may be accessed by us or transferred to us in the United States or to our affiliates, partners, merchants, or service providers who are located worldwide. If you are visiting our Services from outside the United States, be aware that your information may be (i) transferred to, stored, and processed in the United States where our servers are located, and our central database is operated and/or (ii) transferred to those third parties with whom we share it as described in this Privacy Policy. By using our Services, you consent to this transfer. We will protect the privacy and security of Personal Information according to this Privacy Policy, regardless of where it is processed or stored; however you explicitly acknowledge and consent to the fact that Personal Information stored or processed in the United States will be subject to the laws of the United States, including, without limitation, the ability of governments, courts or law enforcement or regulatory agencies of the United States to obtain disclosure of your Personal Information. |

We will respond to such inquiries within fifteen (15) business days. B. Opting-Out. Providing our Service relies on you disclosing certain Personal Information to us that we process and share in accordance with this Privacy Policy. You may opt out of sharing Personal Information with us but please be aware that electing to do so my limit your use of the Services, or preclude your use of the Services entirely.
